These Terms and Conditions (“Terms”) govern your use of the TM-REGISTER website, renewal assistance request form, and any subscription, data, or related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
1. Who We Are
TM-REGISTER is a data and workflow platform focused on trademark information and renewal windows. We are not a law firm and do not provide legal advice. When you submit a request for renewal assistance, we may connect you with an independent attorney or law firm, who will handle any legal representation under their own engagement terms.
2. Eligibility
You may use the Services only if you are at least 18 years old and legally able to enter into contracts. By using the Services, you represent that you meet these requirements.
3. Use of the Services
You agree to:
- Use the Services only for lawful purposes and in accordance with these Terms.
- Provide accurate and complete information when submitting renewal requests or subscribing to any service.
- Not attempt to interfere with or disrupt the operation of the Services or our infrastructure.
You may not:
- Use the Services to send spam or unsolicited commercial messages.
- Reverse engineer, scrape, or misuse data in a way that violates applicable law or third-party rights.
- Misrepresent your identity or affiliation when using the Services.
4. Renewal Assistance Requests
When you submit a renewal assistance request, TM-REGISTER may route your information to an independent attorney or law firm. We are not responsible for the legal advice or services provided by any attorney, nor for the outcome of any engagement between you and that attorney. Any attorney-client relationship is formed solely between you and the attorney.
5. Attorney Subscription Services
For attorneys and law firms, we may offer recurring subscription services that provide access to lists of renewal-eligible registrations and related data. Subscription details, including pricing and delivery frequency, are described on the applicable product page.
Unless otherwise stated, subscription fees are billed in advance and are non-refundable except where required by law. You are responsible for canceling before the next billing cycle if you do not wish to continue your subscription.
6. Payments
Payments for subscriptions or other paid services are processed by third-party payment providers. You authorize us and our payment processors to charge your selected payment method for applicable fees. We are not responsible for errors or issues arising from payment providers beyond our reasonable control.
7. Intellectual Property
The TM-REGISTER name, logo, website design, and proprietary software, as well as compiled datasets and outputs derived from USPTO data, are owned or licensed by us and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services solely for your internal business or personal purposes, subject to these Terms.
8. No Legal Advice
Information provided through the Services, including data about trademark registrations or renewal windows, is for informational purposes only and is not legal advice. You should consult a qualified attorney regarding your specific situation. TM-REGISTER does not guarantee that any particular registration will be accepted, maintained, renewed, or otherwise approved by the USPTO or any other authority.
9. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely accurate.
10. Limitation of Liability
To the maximum extent permitted by law, TM-REGISTER and its owners, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits or revenue, arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to us for the Services during the six (6) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless TM-REGISTER from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your infringement of any rights of another person or entity.
12. Changes to the Services and Terms
We may modify or discontinue parts of the Services at any time. We may also update these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of the Services after any change constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms and any disputes arising from or relating to them will be governed by and construed in accordance with the laws of the United States and, where applicable, the laws of the state in which TM-REGISTER is operated, without regard to its conflict of law principles.
